As components of our general real estate litigation practice, we negotiate and litigate easement/access issues, encroachments, boundary disputes, damages to real property (tree damage), real estate fraud, lien claims, disclosure deficiencies, title defects, adverse possession claims, farm and ranch property rights, breaches and enforcement of purchase and sale agreements, partitions, and trespass to try title claims. In addition, we routinely represent parties to real estate transactions, and negotiate, draft and review deeds, conveyance instruments, seller-financing documents, mechanic’s liens, residential leases, commercial leases, purchase and sale contracts, development agreements, letters of intent, promissory notes, bills of sale, releases, boundary agreements, construction contracts, foreclosure documents, lis pendens, option agreements, and other documents.
We represent water utilities and water rights holders in the areas of groundwater district permitting, service area/CCN disputes, shared water well agreements, utility service agreements, water rate contests, groundwater rights conveyances, negotiation and drafting of water supply/water sales contracts, groundwater leases, Edwards Aquifer Authority and Texas Commission on Environmental Quality (TCEQ) enforcement actions, TCEQ permitting and protests, administrative litigation before the State Office of Administrative Hearings (SOAH). We also handle water-related litigation on behalf of and against utilities, districts and municipalities.
We represent HOAs/POAs and property owners aggrieved by them in matters related to restrictive covenant (CCR) enforcement, interpretation of deed restrictions, dedicatory instrument drafting and amendment, By-law interpretation and enforcement, assessments and collections, common area disputes, community association manager claims, liens and foreclosures, meeting and election/voting issues, contract disputes and liability/insurance/premises claims. We also represent property owners in connection with individual efforts to enforce restrictions.
We provide regular counsel to a stable of real estate brokerages and property management firms. We offer general representation and advice, furnish opinions on governing rules and regulations, review and draft contract and representation documents, handle commission disputes and defend Texas Real Estate Commission (TREC) complaints. Our daily involvement with the real estate community has revealed that not all TREC licensees are worthy of the public confidence and fiduciary responsibilities entrusted to them. Accordingly, we have developed a penchant for aggressively pursuing those real estate professionals who intentionally or negligently breach the public trust by violating the Texas Real Estate License Act, TREC Rules and professional standards.
